WPMark Beta Programme Terms

These terms apply when you join the WPMark beta programme, for example by signing up at atulsingh.co.in/wpmark and ticking the box to accept them. Please read them. They are short on purpose, and they matter: WPMark is experimental software, offered free, as is.

1. Who we are

The beta programme is run by Atul Singh, an individual based in India, trading as atulsingh.co.in ("we", "us"). Contact: join@atulsingh.co.in.

2. What the beta programme is

  • WPMark is a free, open-source WordPress plugin that lets AI apps read your site's content, SEO settings and form entries.
  • The beta programme gives you early versions, a setup guide, updates, and a way to send feedback. It is an experiment: features may change, break or be removed, and the programme may pause or end at any time.
  • Taking part is voluntary and free. You can leave at any time.

3. Who can join

You can join if you are at least 18, and you are joining for business or professional purposes on behalf of a business that owns or runs the website you install WPMark on. You must be authorised to install plugins on that site and to decide how its data is used. If you join on behalf of a company, you confirm you can accept these terms for it.

4. Your consent

By joining you confirm that you:

  • have read and accept these terms and the beta privacy notice;
  • understand WPMark is pre-release, experimental software and use it at your own risk; and
  • agree to receive emails about the beta. You can stop them at any time with the link in each email or by writing to us.

5. The software licence

WPMark is licensed under the GNU General Public License v3 or later. These terms don't limit your rights under that licence. They cover the beta programme: early access, guidance, communications and feedback. Where these terms and the GPL overlap on the software itself, the GPL applies, including its disclaimer of warranty (sections 15 and 16).

6. Your responsibilities

You are responsible for:

  1. Testing safely. Try WPMark on a staging or test site first. Keep current backups of your site.
  2. Your website and hosting, including security, updates and other plugins.
  3. Your data and your visitors. You decide whether to enable lead tools and at what level. You are responsible for having a lawful basis, an up-to-date privacy notice, and contracts with the AI providers you use. See privacy and your data.
  4. Your AI provider accounts. Your use of Claude, ChatGPT, Gemini or any other AI app is governed by that provider's terms and your agreement with them. We are not affiliated with them and have no control over them.
  5. Checking AI output. AI answers can be wrong or incomplete. Verify them before relying on them or acting on them.
  6. Keeping credentials private. Never send us passwords, connection keys or visitor data. Don't post them in public places such as GitHub issues.

7. What we don't do

  • WPMark does not send us your site's content, form entries or usage data.
  • We don't access your website unless you choose to give us temporary access for help. If you do, you control that access and should remove it afterwards.
  • We don't sell your information.

8. No warranty

WPMark and the beta programme are provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and that the software will be uninterrupted, secure or error-free. No advice or information from us creates a warranty.

9. Limitation of liability

To the fullest extent permitted by applicable law:

  • we are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, business, goodwill or data, arising from WPMark or the beta programme, even if we were told it was possible;
  • we are not liable for the acts or omissions of third parties, including AI providers, hosting companies, and WordPress or other plugins; and
  • our total liability for all claims relating to WPMark and the beta programme is limited to INR 5,000 (or its equivalent in your currency).

Nothing in these terms limits liability that cannot legally be limited, such as liability for fraud, or for death or personal injury caused by negligence. It also does not remove rights you have under consumer protection laws that cannot be waived.

10. Your indemnity

You agree to take responsibility for claims by third parties (including your website visitors) arising from your use of WPMark in breach of these terms or of applicable law, for example processing visitor data without a lawful basis.

11. Feedback

We'd love your feedback: ideas, bug reports, and what you ask the AI. You give us permission to use feedback you send, without payment or obligation, to improve WPMark and related work. We won't publish your name, company or quotes (for example as a testimonial or case study) without your separate, explicit permission. Please remove any visitor data from feedback before sending it.

The beta programme is free. If you ask us for custom development, setup, training or other paid services, that work is covered by a separate written agreement, not by these terms.

13. Ending

You can leave at any time: uninstall WPMark and ask us to remove you from the programme. We can end the programme, or your participation, at any time, for example if these terms are breached. Sections 8 to 11, 14 and 15 continue after it ends.

14. Changes

We may update these terms, for example when the programme changes. We'll post the new version with a new date and, for material changes, email beta members. If you keep taking part after a change, you accept the new version.

15. Law and disputes

These terms are governed by the laws of India. If a dispute arises, please contact us first: we'll try in good faith to resolve it within 30 days. If we can't, the courts of competent jurisdiction in India have exclusive jurisdiction. This doesn't deprive you of any protection given by mandatory laws of the country where you live.
